These terms and conditions govern your use of one of Practice Pal's subscription services which are provided to you by Practice Pal using Stripe as a payment processor. Please read them carefully.
Students can subscribe to a regular supervised practice session with our trained practice supervisors. These sessions occur at a regular time and date each week booked in advance. Sessions frequency and times can be managed via the account holders dashboard. Practice supervisors help students focus during their practice time encouraging them to work through their teachers notes, but practice supervisors do not teach their instrument during these sessions.
Teachers can subscribe to be able to use the safeguarded online teaching application. This gives tools including lesson scheduling and note taking alongside the ability to connect with their students for online lessons. Students can download and use the mobile app for the lesson for free.
You must ensure that the details provided by you during the registration process or at any time are correct and complete. You must only register your own credit or debit cards and bank accounts that you have the right to use.
To avoid having an interrupted auto renew service, you must inform us immediately of any changes to the information that you provided when registering by updating your personal details.
We reserve the right to decline your application for a subscription account.
During the registration process you will have created a username and password. You must keep this username and password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your username and password. If you know or suspect that someone else knows your username or password you should notify us by contacting Practice Pal via [email protected]
If we have reason to believe that there is likely to be a breach of security or misuse of this auto renew service, we may require you to change your password or we may suspend your account at our discretion.
After you've registered and submitted all relevant personal information and your initial payment is accepted by Stripe, your agreement with Practice Pal runs from the date of this payment.
We can change this agreement at any time by placing amended auto renew terms and conditions on the Practice Pal website. We will give you reasonable notice of any changes. We will notify you of material changes directly, for example by email to the address you provided when you registered for your subscription service. If you do not agree with the new agreement, you may stop using the service. If you continue to use your subscription service after the date on which the change comes into effect, your use of the subscription service indicates you agree to the changed agreement.
You may cancel mentor sessions at any time online through your account. If you cancel a mentor session with less than 48 hours' notice, you will be charged for that session since Practice Pal will already have paid the mentor for their services.
Practice Pal may on occasion need to cancel mentor sessions where the mentor is unavailable for any reason. This may sometimes happen with very short notice. If this happens, we will contact you as soon as possible and you will not be charged for the cancelled session.
You may end your agreement at any time. Log into your account
practicepalmusic.com and cancel your subscription service.
Student practice accounts would need to be cancelled more than 48hrs in advance of any future booked in session or payment for that session will be taken as normal.
Teachers application subscriptions can be cancelled at any time, if your monthly payment has been taken you can continue to use your subscription until the end of that calendar month
We may end our agreement with you at any time by giving you 30 days notice. We may also end our agreement with you immediately if:
you do not pay us for your subscription service,
you break an important term of your agreement with us (for example, you do not comply with section 11),
you break any other term of your agreement with us and do not put it right within 7 days of us asking you to,
we reasonably suspect fraud or money laundering by someone using your Practice Pal account(s),
you give us information about yourself which we reasonably believe to be false or misleading,
we are no longer able to provide your subscription service to you despite best efforts to do so,
any of the circumstances in paragraph 6.3 occurs.
Under paragraph 6.2.7. we can end our agreement with you immediately if:
bankruptcy or insolvency proceedings are brought against you, or an arrangement with your creditors is made, or a receiver or administrator is appointed over any of your property or belongings, or you go into liquidation,
one or more payments for your subscription services using your provided payment details cannot be collected on time,
payments collected successfully by us for your subscription services using your provided account details are subsequently disputed by you or your card issuer or bank.
When your Agreement with us ends, you must pay us for all outstanding orders.
We may suspend your subscription service immediately:
if we need to carry out repairs, maintenance or the introduction of new aspects to this service (and we will try to restore the service as soon as we can),
if we are told to by the Government, the emergency services or any other competent or lawful authority,
to protect you under paragraph 7.2, or
if any of the circumstances in paragraph 6.2 occurs.
Sometimes, it may appear to us that there is an unusual use of your subscription service (for example, the volume of practice sessions loaded increases significantly and we reasonably suspect fraudulent use). If this does happen we may suspend your use of this service to prevent you from incurring excessive or unwanted charges.
Payment details you provide during the registration process are stored by Stripe according to their terms and conditions but not by Practice Pal.
During the registration process your credit and / or debit cards will be authenticated online by the card issuers using our secure facilities. Each time the details of your credit and / or debit cards are changed, they will be immediately authenticated online by the card issuer.
When we provide you with your subscription service, we will use the reasonable skill and care of a competent service provider.
We shall not be responsible for any delay or failure to provide this subscription service for reasons beyond our control.
You must use the subscription services in accordance with your agreement with us and any other reasonable instructions Practice Pal or Stripe give you.
Our subscription services are consumer service. If you do use the services for business or commercial purposes you will compensate us for all liabilities, claims, damages, losses and costs (including legal costs) which we may suffer because someone (other than you) makes or threatens a claim against us because this auto renew service is faulty or cannot be used by them.
If you pay by debit or credit card, payment is authorised on the debit or credit card registered to your Practice Pal account at the time you place your order.
Payments made for using the subscription services appear on your statement as either "Practice Pal sessions" or "Stripe technologies"".
When will payment be taken for your subscription?
Student supervised practice subscriptions will be charged weekly for the practice sessions they have booked. This charge is made at the end of each week according to your use of the service in the week preceding the payment.
Teachers application subscriptions will be charged monthly on the date you request when setting up your account.
Because, once you place your subscription request, we begin the process of providing the subscription service to you, you cannot cancel that request.
You must not knowingly request a subscription service using a credit or debit card with insufficient funds available.
We do not exclude or restrict our liability for: (a) death or personal injury caused by our negligence, (b) fraud, or (c) any of our liabilities that cannot by law be excluded or restricted.
We are responsible for direct losses you suffer as a result of us breaking this agreement with you if the losses are a foreseeable consequence of us breaking this agreement. Our liability to you in relation to this auto renew service is limited to £250 for each auto renew account that is affected (up to a maximum of £500 in any 12 months). We are not responsible for indirect losses which happen as a side effect of the main loss or damage or which are not foreseeable by you and us (such as loss of profits, wasted expense or loss of opportunity). If you suffer any loss you must let us know as soon as possible by contacting us using the form on www.practicepalmusic.com/contact
If you have set up a subscription service, make sure you cancel your subscription if you no longer use it, or you may be charged.
If any part of your agreement with us is found to be invalid by any Court or other regulatory or competent body, the invalidity will not affect the rest of the agreement, which shall remain in force.
Any notices or communications that you send to us must be sent to [email protected] Any notices or communications that we send to you will be sent by email to the email address registered with your auto renew account. All notices or other communications will be deemed to have been received 24 hours after sending.
English law applies to your agreement with us, and any disputes about this agreement will be decided exclusively in the English courts.
